Case file for United States vs. John A. Sutter, New Helvetia (also called "Nueva Helvetia" or "Sobrante") [Sacramento and Sutter County]. Includes transcript of the proceedings and related documents.
Granted (1) by Alvarado June 18, 1841, New Helvetia, 11 leagues, by name, and (2) by Micheltorena Feb. 5, 1845, the sobrante of 22 leagues. The first grant was to John A. Sutter and the second to John A. Sutter Sr. and John A. Sutter Jr. Claim filed by John A. Sutter Mar. 8, 1852, for both grants. Confirmed by the Board May 15, 1855. Confirmed by the District Court Jan. 14, 1857. The Supreme Court confirmed the grant of New Helvetia of 11 leagues but rejected the grant of the sobrante of 22 leagues Feb. 14, 1859, because of lack of archive evidence and because of the circumstances under which the sobrante grant was made proved it invalid. On Mar. 8, 1865, the Supreme Court, by mandate, passed on the survey of New Helvetia grant. Patent issued to John A. Sutter June 20, 1866, for 48,839.30 acres. The patent is found in this case, 319 ND, but without the surveyor's plat. In Yuba County 25,375.55 acres; in Sutter County 14,584.74 acres, in Sacramento County 8,879.01 acres. In the titulo the name is written Nueva Elvecia; and on the traced diseño in the case it is written Nueva Helvecia. Bowman, J.N.
