Description

Case file for United States vs. Andrés Pico, Elias L. Beard, and John M. Horner, Ex-Mission San José [Alameda County]. Includes transcript of the proceedings and related documents.
Granted by Pico May 5, 1846, to Andrés Pico and Juan B. Alvarado; 26,508.57 acres, as a sale of the mission lands for $12,000 and the purchasers to pay the mission debts. Claim filed by Andrés Pico, Elias L. Beard, and John M. Horner Mar. 22, 1852. Confirmed by the Board Dec. 18, 1855. Rejected by the District Court July 2, 1859, because the governor had no authority to sell lands, and because of the absence of archive evidence of a grant. Appeal dismissed and cause remanded by the Supreme Court Apl. 18, 1864, and Apl. 18, 1867, both by mandate. An opinion was delivered by the District Court June 30, 1859. Bowman, J.N.
